This “Debt Validation Letter” is the second round (Rd.2) letter to send to the credit bureaus, concerning a debt that they did not remove after their initial investigation. This letter is the second part of the validation process; it helps remove negative collections from your credit file. It demands proof that the debt in question is yours, valid, and is compliant with the FCRA. This letter also request immediate removal of the negative items.
FEDERAL FAIR DEBT COLLECTION PRACTICES ACT
The Fair Debt Collection Practices Act (FDCPA) is a federal law. It provides limitations on what debt collectors can do when collecting certain types of debt. The FDCPA covers how debt collection is reported in credit reports. In addition, there are state laws that provide protections. You can find information on the statute of limitations for collecting a debt in the Federal Fair Debt Collections Practices Act (FDCPA). If the debt that is in question exceeds the statute of limitations, collection efforts can no longer be pursued.
HOW TO USE THIS LETTER
With this debt validation letter, you can request actual documentation from the credit bureaus. You can ask for documentation proving that the debt is yours. If the collection agency can not provide this information to the credit bureau within 30 days, they have to remove the negative item(s) from your credit report per the FCRA.
