This 611 dispute letter – round 1, is great for removing negative items from your credit report. This is a amazing letter because it works wonders as far as removing negative items. Because this letter is so amazing, I would use it after receiving a reply from the initial validation letter. I would send it after receiving an answer stating that the disputed item has been verified.
The Fair Credit Reporting Act § 611
Because the fair credit reporting act 611 and 609 are combined together in this letter, it makes it very effective. If you are not familiar with these laws, please read on.
FCRA § 611 Procedure in case of disputed accuracy [15 U.S.C. § 1681i](5) Treatment of Inaccurate or Unverifiable Information (A) In general. If, after any reinvestigation under paragraph (1) of any information disputed by a consumer, an item of the information is found to be inaccurate or incomplete or cannot be verified, the consumer reporting agency shall–(i) promptly delete that item of information from the file of the consumer
FCRA 609 Grant You Rights
When the answer to your dispute comes back “verified”, then you ask for documentation. You have a right to request the documentation that they used to verify that dispute. In this letter you are requesting that the Credit Bureaus provide you with the following information, or delete that disputed item off your credit report.
- The name of the original creditor
- The address and phone number of the original creditor
- The name of the person at the credit reporting agency who verified the dispute with the original creditor
- The documents that were used to verify your dispute
Fair credit reporting act 609 grants you the right to request this information.
FCRA 609. Disclosures to consumers [15 U.S.C. § 1681g] (a) Information on file; sources; report recipients. Every consumer reporting agency shall, upon request, and subject to 610(a)(1) [§ 1681h], clearly and accurately disclose to the consumer: (1) All information in the consumer’s file at the time of the request.
